How will my compensation be calculated?

When your solicitor assesses your claim to establish how much compensation you're entitled to, they'll combine two key elements: 

  • General damages, which are awarded for pain, suffering and loss of amenity (PSLA).
  • Special damages, which are awarded for any financial losses or costs you've incurred.

What are general damages?

The term ‘general damages' describes money awarded for the type of injury you've suffered and how severe it is. 

Measuring pain and suffering can be challenging, but your solicitor will refer to the Judicial College Guidelines, which set out fair compensation amounts for different types of injuries.   

What are special damages?

Special damages cover any financial losses or expenses you've incurred as a direct result of your injury. The idea is that your compensation will put you back in the financial position you were in before your injury. 

Special damages are calculated based on a range of expenses including:

  • Loss of past and future earnings. Have you had to take time off, change jobs or stop working altogether?
  • Medical treatment and care costs. Will you need ongoing care?
  • Equipment and adaptations. Do you need tools or home alterations to live your life comfortably, such as a wheelchair or stairlift?
  • Travel expenses. Did you have to take multiple trips over long distances to access medical care?

  • The cost of any insurance policy required to make your claim risk-free.
  • Any legal costs that aren't paid by the opposing party.
  • A ‘success fee', if applicable, as payment for their legal support, which acknowledges the risk that they won't be paid at all if your claim is unsuccessful. 

Your solicitor will discuss these costs clearly and openly with you before starting your claim, and any deductions will be capped at a level agreed upon by you. This way you won't face any surprises.

What happens if my claim is unsuccessful?

Our personal injury claims calculator offers an idea of the compensation you could receive. But in the unlikely event that a solicitor agrees to take on your claim and it turns out to be unsuccessful, the important thing is you'll have nothing to pay whatsoever.
