Chemical burn and poisoning claim FAQs

We know you're likely to have questions about your chemical injury claim, and hopefully the information below will provide you with all the answers you need.

What are the common causes of chemical accidents?

Sadly, chemical accidents in the workplace are all too frequent. Data from the Health and Safety Executive for 2021 reveals that each year there are around 13,000 deaths linked to previous exposure to dust or chemicals. Common causes of accidents include:

  • User error
  • Equipment failure
  • Sub-standard health and safety reviews
  • Warnings being ignored

Your employer has a duty of care to your wellbeing at all times. So, if you've suffered a chemical burn, poisoning, or exposure where someone else was to blame, you could be entitled to claim for compensation.

What is a no win no fee chemical injury claim?

A no win no fee claim is also sometimes known as a conditional fee agreement. It means there is nothing for you to pay if your case is unsuccessful.

These types of agreements were brought in to help those who were entitled to compensation but could not afford the legal representation. We take most cases on a no win no fee basis, so your solicitor will cover all of the expenses for you. Then, if you are successful, your solicitor will receive a percentage of your chemical burn settlement as payment for their services.

Am I eligible to claim for a chemical exposure settlement?

If you've suffered an injury - be it a severe or minor chemical burn, poisoning, exposure, or anything else - in the last three years and someone else was to blame, you have the right to seek compensation.

We'll make an immediate assessment and if your solicitor agrees to take on your case, you can take that as a sign that they're confident of winning. You can also claim on behalf of someone else if their chemical burns or poisoning are so serious that they are unable to do so for themselves.

How do I start the claims process?

You can begin your chemical injury claim in one of three ways:

  • Call one of our advisors on 0808 239 8382. Our lines are open seven days a week including Bank Holidays and we'll let you know straight away if you have a strong case.
  • Fill out our simple form with your name, number, and the details of your injury. We'll call you back at no charge.
  • Use our chemical burn at work compensation calculator for an instant valuation. From there, you may be able to pursue your case entirely online.

How does the claims process work?

If we decide you have a strong chance of successfully claiming for a chemical exposure settlement, the process will usually follow these steps:

  1. Your solicitor will listen to your story and understand how your chemical injury has affected you. They may ask for supporting evidence such as photographs, medical records, and the contact details for any witnesses.
  2. Your solicitor will then contact the responsible party and inform them that you intend to make a claim.
  3. That party will either accept the blame for what happened or contest it. If the latter, your solicitor will begin negotiations on your behalf.
  4. If you win your chemical injury claim, you'll receive your compensation and your solicitor will take a pre-agreed cut as their fee. If you lose, there will be nothing for you to pay.

Can I make a chemical poisoning claim online?

Yes, our calculator tool will let you know if you can continue with your claim online. And we're different to other personal injury companies, who use their calculator just to get you to contact them. When you use ours, you'll get an immediate idea of how much chemical injury compensation you could receive.

How long will my claim take?

It is impossible to put an exact timeframe on your chemical injury claim because no two cases are the same. It can depend on many different factors, such as the severity of your injuries and whether the other party accepts responsibility for what happened.

But rest assured when you get in touch, we'll let you know straight away if we think you have a case.

How much will I receive in chemical injury compensation?

Again, this will depend on a number of things, including the seriousness of the injuries as well as any other long-term effects - for example if your ability to work has been affected.

When assessing potential chemical exposure settlement amounts, we follow the 15th edition of the Judicial College Guidelines, which also informs our compensation calculator.

Do I need no win no fee insurance?

We would recommend taking out After the Event insurance, which can make claiming for chemical injury compensation risk-free. It's a policy that will cover all the legal costs of your case, in the unlikely event that you lose.

Your solicitor will be able to organise this for you and there won't be anything for you to pay upfront. You'll only need to pay for the cover if you win, and that will be taken out of your compensation.

Will my claim go to court?

Most chemical injury claims are settled without going to court. But rest assured if yours does go that far, your solicitor will take care of all the legal proceedings and make sure you're fully updated every step of the way.

What if I lose my chemical injury claim?

We handle most cases on a no win no fee basis. So, even if your claim is unsuccessful, there'll be nothing for you to pay.
