What sort of injuries can I claim accident compensation for? What sort of injuries can I claim accident compensation for?

You can claim compensation for a wide variety of injuries, ranging from relatively minor whiplash up to fatal injuries. Other examples include:

What is a no win no fee accident claim and how does it work?

No win no fee is also known as a conditional fee agreement. It is a contract between you and your accident injury solicitor. No win no fee arrangements were brought in so that people who couldn't afford legal representation could claim for the compensation they were entitled to.

It means that all the costs of your case are covered by your lawyer and if you lose, there is absolutely nothing for you to pay. It offers complete peace of mind and if you win your accident claim, your solicitor will simply take a percentage of your compensation as their payment.

Am I eligible to make an accident claim?

If you've been hurt in an accident in the last three years and someone else was to blame, we believe that you have the right to legal representation. A no win no fee arrangement means we can offer this service regardless of your personal or financial situation.

If your accident injury solicitor agrees to take your case on, that's a sign that they're confident of winning. There'll be no upfront costs and you'll only pay if you are successful. In the unlikely event of your case losing, there will be absolutely nothing to pay.

You can make an accident claim for someone else, too. If their injuries mean they're incapable of doing so for themselves, you can get in touch with us on their behalf.

How do I start with making an accident claim?

There are a few different ways you can begin the claims process:

  • You can call us to speak to one of our advisors on 0800 587 0344. We're open seven days a week until late and we'll let you know straight away if you have a case.
  • Fill out our form with your name, telephone number and type of accident. We'll give you a call back at no cost to you.
  • Use our compensation calculator for an immediate claim valuation. Depending on the claim type, you may be able to pursue the matter completely online.

How does the claims process work?

Once we've confirmed you have a case for accident compensation, your claim will follow these steps:

  1. Your accident solicitor will get a picture of how the injury has impacted your life. They may need you to provide evidence, such as photographs or medical documents.
  2. Once they have everything they need, your solicitor will notify the person or organisation who were responsible for causing your injury.
  3. The other party will either accept they were at fault or contest it. If it's the latter, your accident solicitor will negotiate on your behalf, keeping you updated at all times.
  4. If your claim is successful you will receive your compensation. Your lawyer will take a cut as a fee for their services. If you are unsuccessful, there's nothing for you to pay.

Can I make a no win no fee accident claim online?

Yes. Our market-leading calculator tool gives you an immediate claim valuation and will also let you know if you can pursue your case entirely online.

Other companies use their calculator tool as a way to encourage you to get in touch, but here at ClaimsPeople we're different.

How long will my claim take?

Every accident claim is different, which means the time it takes to process each one can vary hugely. It will depend on a lot of factors, such as the nature of your injuries, how much evidence needs to be gathered and whether the other person accepts the blame for what happened.

Rest assured we'll assess your claim quickly and let you know straight away if you have a case. And your accident injury solicitor will provide end-to-end support, fighting your corner every step of the way.

How much compensation can I receive?

No two accident claims are ever the same, so it's difficult to provide a simple answer to this question. The amount of compensation you receive will depend on several things, such as the severity of your injury and the effect it has had on your physical, mental and financial wellbeing.

For example, a successful whiplash accident claim may see you receive a few hundred pounds in compensation, whereas a serious break or fracture could mean you're paid tens of thousands. Any compensation you do receive will be paid by the other party's insurance company.

We follow the 15th edition of the Judicial College Guidelines for the assessment of damages, as set out by the Ministry of Justice.

How much do I pay my accident solicitor if I win?

If you win your case, your legal costs will be partly paid by the person to blame for your accident. The remainder will be paid out of your compensation. These costs might include the insurance that backs your no win no fee claim, legal costs, or a success fee for the accident solicitor.

Any deduction will be capped at an agreed level, and you won't pay anything if you lose your case. Your accident claim lawyer will talk you through all this before you begin, so there will be no hidden surprises or disagreements once your case is settled.

Do I need to take out no win no fee insurance?

We typically recommend you allow us to organise no win no fee insurance (also known as After the Event insurance) for you when making a no win no fee accident claim. Handled by us, with no upfront costs, this cover pays for your legal costs if you lose your case, giving you complete peace of mind.

This insurance covers costs and expenses paid out on your behalf including expert reports, barristers' fees and court fees. If you lose your case, it is this insurance that covers these costs, so you don't have to pay them. If you win, the cost is a capped charge which is agreed upon by you before the case begins, meaning zero surprises.

Is my case likely to go to court?

The vast majority of accident claims are settled out of court, so the chances are slim that yours will go that far. However, if the other party refuses to accept liability and a successful negotiation cannot be reached, the matter will have to be decided by a judge.

If that does happen in your case, you can be confident your accident injury solicitor will be firmly in your corner. They'll take care of all the legal legwork so you don't have to worry, and they'll keep you updated every step of the way.

What if my accident claim is unsuccessful?

Our no win no fee claims are so simple and straightforward. If your accident injury claim is unsuccessful, you won't be charged a thing.

That's because the vast majority of our accident compensation claims are covered by After the Event no win no fee insurance. This covers all legal, court, barristers', and medical report costs if you lose your case. And due to the way this insurance is organised, you won't have to pay the policy costs either.
