Crush injury compensation claim FAQs

We know you might have questions so we've pulled together the answers to some of our most frequently asked questions about claiming for your crush injury.

What are the common causes of crush injuries?

Crush injuries can be caused by any number of incidents, for example:

What is a no win no fee crush injury claim?

With a no win no fee claim, there's nothing for you to pay if your case loses. It's also known as a conditional fee agreement (CFA) and it's essentially a contract between you and your crush injury compensation lawyer.

No Win No Fee agreements were introduced into law to give people who couldn't afford legal representation the chance to access the justice they were entitled to. When you make a no win no fee claim with us you can rest assured that your personal injury solicitor will pay for absolutely everything - they will pay for all the costs and expenses, associated with your claim, throughout the entirety of your case. Literally everything will be paid for by your solicitor, so you genuinely don't have to worry about the cost.

Am I eligible to claim crush injury compensation?

If you've suffered a crush injury in the past three years and someone else was at fault for what happened, you have the right to claim compensation.

We'll provide an instant claim assessment and if your solicitor takes on your case it means they're confident of a successful outcome. Our panel work on a no win no fee basis, so even if you do lose your case there'll be nothing for you to pay. Unlike many solicitors we provide you with complete certainty and protection on legal costs.

You can also claim on behalf of someone else if they've suffered such a severe crush injury that they are unable to do so themselves.

How do I start the claims process?

Starting your crush injury compensation claim is easy, and can be done in a few different ways:

  • Call one of our advisors on 0800 587 0344. Our lines are open seven days a week until late and we'll tell you straight away if you have a claim.
  • Fill out our form with your name, number and the details of your accident. We'll call you back, completely free of charge.
  • Use our crush injury compensation calculator tool for an immediate valuation. From there, you may even be able to proceed with your claim entirely online.

How does the claims process work?

Once we've decided you have a legitimate claim, things will usually proceed as follows:

  1. Your crush injury compensation lawyer will listen to how your accident has impacted you. They may also ask for evidence of the damage done, such as photographs, medical records and the details of any witnesses.
  2. Once they have all the information, your lawyer will contact the party at fault to let them know you're making a claim.
  3. That party - be it an individual, or a business - will either accept the blame or contest it. If they contest responsibility, your lawyer will begin negotiations on your behalf.
  4. If you win your claim, you will receive your crush injury compensation and your lawyer will take a cut as payment for their services. In the unlikely event that your claim is unsuccessful, there'll be nothing for you to pay.

Can I make a crush injury claim online?

Other personal injury companies use their calculator tool simply to get you to contact them. But at ClaimsPeople, we're different. Our compensation calculator is a genuine calculator valuation tool which will give you a good idea of how much compensation you could receive. The tool will also let you know if you can pursue your crush injury claim entirely online.

How long will my claim take?

We'll assess your claim and let you know straight away if we think you have a claim. Your solicitor will offer end-to-end support, looking after all the legal proceedings and keeping you updated every step of the way.

Some claims can take longer to settle than others and the time frame can depend on several things, such as how severe your crush injury is, how much evidence needs to be gathered and whether the other party accepts the blame for your accident.

How much crush injury compensation can I win?

No two crush injury claims are the same, so it's hard to offer a simple answer to this question. When assessing damages, we follow the 15th edition of the Judicial College Guidelines, which also inform our compensation calculator.

Do I need no win no fee insurance?

We usually recommend taking out what's known as After the Event (ATE) insurance to make your crush injury claim risk-free. It's a policy that covers all the legal costs on your behalf in the unlikely event that you lose your case.

We will take care of this for you and there is nothing to pay upfront. You will only pay the premium if you win your claim, and that will be included in our overall cap on charges, so there'll be no nasty surprises once your case is settled.

Is my claim likely to go to court?

Most crush injury claims are settled without having to go to court. However, your case may need to be heard by a judge if the other party does not accept the blame for what happened. But rest assured your solicitor will look after all the legal proceedings and keep you updated every step of the way.

What if I lose my crush injury claim?

If your claim proves unsuccessful, there'll be nothing for you to pay. That's because we handle most cases on a no win no fee basis.
