What is a no win no fee amputation injury claim?

Simply put, a no win no fee claim is a type of agreement between you and your amputation compensation lawyer. It means you don't have to pay any legal fees if you lose your case.

How does the claims process work?

Once we've agreed to take on your claim, the process usually follows these steps:

1. You'll tell your amputation claim lawyer your story in detail, including how you've been affected by the injury. You may need to give any supporting evidence that you have, such as photographs, medical records or details of any witnesses.
2. Your solicitor will tell the other party that you intend to make a claim.
3. If the other party takes responsibility for what happened, your claim should be resolved fairly quickly. But if they don't, your lawyer will negotiate on your behalf.

If you win, you'll receive amputation compensation and your solicitor will take a pre-agreed amount of the settlement figure as payment. If you lose, you don't have to pay anything.

How much compensation can I get for the loss of a limb?

The amount of compensation you get for your amputation varies and will depend on the details of your case. This makes it difficult to give a straightforward answer to this question.

As an example, how much compensation you get for an amputated leg would be different from how much you get for a toe or partial finger amputation.

How much will I pay my amputation claim solicitor?

If you win your case, your amputation claim solicitor will take a pre-agreed amount from your settlement. This may include a success fee and the cost of any insurance taken out to make your claim risk-free. 

This amount may also be affected if the other party in your case is required to contribute towards your legal fees in the terms of the loss of limb settlement.

Any deductions from your compensation will be capped at a level you agree to before you begin. Your solicitor will communicate every detail to you, so you don't need to worry about any surprise fees.

Do I need no win no fee insurance?

To make your claim truly risk-free, we recommend you take out After the Event (ATE) insurance. It's designed to cover all the legal fees involved in your amputation claim so you don't have to pay anything, even if you lose.

Your expert solicitor will organise your policy and you won't have to pay any premiums upfront. Instead, these costs will be deducted from your amputation settlement and are included in our overall cap on charges.

What if I lose my claim?

Since we take most cases on a no win no fee basis, there'll be nothing for you to pay if you lose your amputation injury claim.
