Hearing loss claims

Data from the Health and Safety Executive reveals that new cases of occupational deafness in Great Britain steadily declined between 2014 and 2018, although there was a sharp rise in 2019 with 95 new incidents.

If you've suffered hearing loss, deafness or tinnitus due to conditions in the workplace, you could be entitled to compensation.

We're ClaimsPeople and our panel of solicitors are here to help you with your industrial deafness claim.

When you get in touch, we'll tell you straight away if you have a strong case. There are no upfront fees and you'll only pay if your hearing loss claim is successful. If it's not, you won't owe a penny.

Hearing loss claims: FAQs

Below you'll find some information that should prove useful before you get in touch about making your occupational hearing loss claim.

What is a no win no fee claim and how does it work?

We take most hearing loss claims on a no win no fee basis, which means you pay nothing if you lose. They're also known as conditional fee agreements, and they were first brought in as a way of ensuring people get the access to justice they deserved without the financial risk.

There'll only be anything to pay if you win - your solicitor will take a percentage of your damages to cover the legal costs of your case and as payment for their services.

Can I claim for hearing loss?

If you've suffered hearing loss, deafness or tinnitus due to noise exposure or an accident in the workplace over the last three years, you could be entitled to compensation. We handle most cases on a risk-free, no win no fee basis so we can help you regardless of your personal circumstances.

We'll provide a fast claim assessment and if your hearing claim solicitor agrees to take on your case, you can treat that as a sign that they're confident of winning. There are no upfront charges and you'll only pay if you win.

You can also make an occupational deafness claim on behalf of someone else, if their condition has left them unable to do so for themselves.

How do I claim compensation for tinnitus?

You can begin your hearing loss, deafness or tinnitus claim in a few different ways:

  • Pick up the phone and call one of our advisors on 0800 587 0344. Our lines are open seven days a week until late and we'll offer a fast claim assessment.
  • If you would prefer to, you can fill out our form with a few basic details and we'll call you back at no cost to you.
  • Use our hearing loss compensation calculator tool for an immediate valuation. From there, you may be able to continue your claim entirely online.

How does the claims process work?

When we've decided that you have a legitimate case for claiming hearing loss compensation, the process will usually follow these steps:

  1. Your hearing loss solicitor will gain an understanding of how your condition has affected you and will ask you to provide any evidence that may be required.
  2. Once they have all the information they need, they'll get in touch with the party who had a duty of care to look after your wellbeing.
  3. If the other party accepts blame, a swift settlement should be possible. If they don't, your solicitor will begin negotiations on your behalf.
  4. If you win your claim, your solicitor will take a percentage of the compensation as their payment. In the unlikely event that you lose, there'll be nothing for you to pay.

Can I claim for hearing loss online?

Other companies use their calculator tool to encourage you to contact them but, here at ClaimsPeople, we're different. You can use ours to gain a genuine valuation of the amount of compensation you could win. Our tool will also let you know if you can press on with your claim online.

How long does an industrial deafness claim take?

When you get in touch, we'll let you know straight away if you have a good chance of winning your industrial deafness claim. Some cases take longer to settle than others, depending on factors such as the severity of your condition and whether the other party accepts responsibility. But rest assured your solicitor will offer end-to-end support and take care of all the legal heavy lifting.

How much is a hearing loss claim worth?

When it comes to hearing loss claims, the average payout is hard to define because all cases are unique. When assessing damages, we follow the 15th edition of the Judicial College Guidelines, which also inform our compensation calculator tool.

How much do I pay my solicitor if I win?

If you successfully claim for hearing loss compensation, the responsible party may have to contribute towards your legal costs. This is unlikely to cover the full amount, so your solicitor will take a percentage of your settlement to account for the rest. This will include any success fee, as well as the cost of any insurance you took out to make your claim risk-free.

Any deductions made from your settlement will be agreed beforehand and your solicitor will explain everything before you begin your claim, so there'll be no surprises at the end of the process.

Do I need to take out no win no fee insurance?

When making a claim for deafness, hearing loss or tinnitus compensation, we recommend taking out After the Event (ATE) insurance. It ensures all legal expenses, such as expert reports and court fees, are paid for on your behalf should you lose your case.

The important thing to remember is that your solicitor will organise all of this for you and there are no upfront fees for this insurance. The premium is only paid if you win and the costs of this are included in our overall cap on charges.

Will my claim go to court?

Most hearing loss claims are settled without the need to go to court. However, if the other party contests your case and an agreement cannot be reached, the matter may need to be decided in front of a judge.

If that happens to you, don't worry. Your solicitor will take care of all the legal matters and keep you updated every step of the way.

What if I lose my hearing loss claim?

In the unlikely event that your claim is unsuccessful, there'll be nothing for you to pay because we handle most hearing loss claims on a no win no fee basis.
